1. Data controller

From SHAFTESBURY RE TEL MADRID, S.L. (“El Viso Residences”) we want to give you some details about how we process the personal data that you provide us when interacting with us.

Thus, this privacy policy applies to all people who provide us or have provided personal data through our website. In this regard, any data collected through the data collection forms on the website or through other channels shall be included in a database owned by El Viso Residences, who will act as data controller. In addition, Knight Frank España, S.A. (“Knight Frank”), will act as data processor by collecting and processing your personal data in our behalf.

2. Purposes for the processing

This entity shall process the data confidentially and for the sole purpose of offering the services requested, with the legal and security guarantees imposed by Organic Law 3/2018 of 5 December on Personal Data Protection and guarantee of digital rights, combined with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the “General Data Protection Regulation” or “GDPR”) and Law 34/2002 of 11 July on Information Society and E-Commerce Services (“LSSI”).

3. Lawful basis

We process the personal data because it is necessary for providing you the services, products or information requested (i.e., performance of a contract or to take steps at your request prior to entering into a contract).

In addition, the lawful basis for sending you commercial communications it is the express consent provided by you or, for those cases where you have previously entered into an agreement with us, the legitimate interest recognized in Article 21 of the LSSI (which allow us to send you communications about our products and services if they are similar to those previously contracted by you). You may withdraw your consent at any time. 

4. Data retention period

El Viso Residences will store the user’s personal data as long as is necessary to provide the services requested. Once this expires, El Viso Residences may keep the user’s personal data, dully blocked, during the time responsibilities may arise or during the time required by an applicable law, making them available only to public administrations, courts and judges.

5. Communication of your personal data

We do not give your personal information to anyone. We will only communicate them when we are bound by law or when you have previously given us your express authorization.

To provide our services, we need to work with companies that process your data on our behalf (hosting providers, email, etc.), as part of the provision of a service that we have hired, with whom we sign the corresponding data processing agreements and to which we demand compliance with the regulations on personal data.

6. User’s rights as regards data protection

7. Protection of your personal data

El Viso Residences adopts the appropriate security measures required by the aforementioned Organic Law 3/2018 and GDPR and other applicable regulations. However, El Viso Residences is unable to guarantee the complete invulnerability of the systems. It therefore accepts no liability for any damages resulting from alterations caused by third parties to the IT systems, electronic documents or user files, subject only to the limits set out in the applicable regulations.

If you choose to leave our website through links to websites that do not belong to us, then El Viso Residences will not be liable for the privacy policy of the said website or the cookies that such websites may store on the user’s computer.
